If you are ever in that situation call a lawyer right after you call the police. Don't talk until your lawyer is there. When they read you your rights, part of it is, "anything you say can and "will" be used against you in a court of law." In all but one state, even though the burden of proof is on the prosecution if you commit a crime, it is different with self defense. If you claim self defense then the burden of proof is on you to prove it was self defense.

There was a single black woman who lived in my city. Two men threatened her and said they would be back the next day to finish the job. She called the police who did nothing. She was poor and didn't have a gun but a friend of hers let her buy a small derringer with only $25.00 down.

The next day the 2 armed men broke into her apartment through her patio door. One of the men had a shotgun and said they were going to kill her. She shot the man with the shotgun and then the other man ran away.

She called the police, they arrested her and held her in jail for 3 days until the public outcry got so bad they had to let her go.

You might be in trouble if you got an unethical, Liberal lawyer that was trying to make a name for him/herself to advance in politics.

The prosecution doesn't have to prove anything. You have to prove that you acted in self defense. This is terrible, stupid, and unfair, but that's the way it is. Only one state recently changed this so that the prosecution has to prove that you didn't do whatever in self defense.

Could you be charged? Yes. Would you? Depends on your state and the situation. Does your state have a "your home is your castle" law? For instance in Massachusetts you have to flee your home unless you are "stuck or trapped"

It depends on the state. In my state you can shoot the burglar and toss his body outside, and the waste disposal company will come by in the morning and dispose of the body. In California you have to serve the burglar tea and crumpets while he's raping your wife.

The first answer that replied is completely wrong. No you will not get arrested for self defense. Even though it must be determined as self defense first. If someone broke into your home and you caught them…this is what would happen. Once you walked in on them and they did not try to get away but come at you to harm you, if you hurt them or kill them it is known as self defense, now on the other hand, when you walk in on them and they try to get away you can not harm them, shoot them, or anything else of this nature. Only then would you be arrested for assault and or murder. You have the right to protect yourself and what is yours.
